AC permits and inspections in Florida, from Oviedo

A residential air conditioning changeout always requires a building permit in Florida. The new $7,500 permit exemption created by HB 803 (2026) expressly excludes any electrical, plumbing, structural, mechanical or gas work on a single-family property, so it never applies to an AC changeout in Oviedo at any price.

The correction

What the 2026 exemption does not do

The 2026 permit exemption does not cover an AC changeout

A residential air conditioning changeout always requires a building permit in Florida. There is no dollar-amount exemption. The new $7,500 permit exemption for single-family work, created by HB 803 (2026) and effective 1 July 2026, expressly does not apply to “any electrical, plumbing, structural, mechanical, or gas work” — s. 553.79(1)(g)2.b., Fla. Stat. — and a changeout is both mechanical and electrical work.

If a quote is cheap because nobody is pulling a permit, that is not a saving the law allows. Bill: CS/CS/HB 803 (2026), ch. 2026-63.

The statute also says a project may not be divided into more than one project to evade the requirement, and a separate carve-out excludes any property partially or entirely in a Florida Building Code flood hazard area — relevant along the Econlockhatchee. The baseline requirement in s. 553.79(1)(a) continues to control.

Getting it right

What HB 803 did and did not do

Two more things get attributed to HB 803 that do not belong to it, and one that does.

You may hire a private provider instead of waiting

Florida law defines a “single-trade inspection” as an inspection focused on one construction trade, and the statute names HVAC replacements in that list. A fee owner — or their contractor with explicit written authorisation — may choose to use a licensed private provider for the plans review or the inspection instead of the local building department.

Two things this is not. It is not a lighter class of permit: the permit is still required. And it is not part of HB 803 — this definition was already in the statute before that bill, and it is an inspection category rather than a permit category.

Five business days — when it applies

Since 1 July 2026 a local government must approve, approve with conditions, or deny a mechanical permit application within 5 business days — but only where the work is on an existing single-family dwelling, the value of the work is under $15,000, and the applicant is using the local government plans reviewer. Plenty of full changeouts now clear $15,000, and those fall into a longer tier of the same statute. Nobody should promise you five days without checking all three.

s. 553.792(1)(a)1., Fla. Stat., added by s. 10, ch. 2026-63.

Oviedo does not publish a residential permit turnaround at all. What the City does publish is the inspection cutoff — scheduled through the portal no later than 3:30 p.m. the prior business day — and whether a simple condenser plus air handler changeout needs a rough-in inspection or only a final is not stated in the guidelines either.

The rest of it

Licence classes and your warranty

Who can pull it: an air-conditioning contractor licensed under Chapter 489, Part I. Under s. 489.105(3) a Class A contractor is unlimited; a Class B is limited to 25 tons of cooling and 500,000 Btu of heating in any one system, which comfortably covers a residential changeout. A certified contractor may work anywhere in the state; a registered one only in the jurisdiction that registered them. State-certified air-conditioning licences carry a CAC prefix. Check any contractor’s, including ours, at DBPR Verify a Licensee.

Your warranty starts at installation, not at registration

In Florida the full length of a manufacturer’s HVAC warranty is effective on the date of installation, provided the installer is licensed under chapter 489 — and the warranty may not be conditioned on your returning a registration card or filling in an online form. If you were told you lost coverage because a card never went back, that is not how the statute reads.

Being told your job does not need a permit?

It does. Ask the contractor for the permit number after the job is applied for, and check it on the City or County portal.
