Do You Need an AC Replacement Permit in Orlando?

Yes. A residential air conditioning changeout always requires a building permit in Florida, in Orlando and everywhere else, and the 2026 $7,500 exemption excludes mechanical work. If your address is Oviedo the permit does not go to Orlando at all: it goes to City of Oviedo Building Services, or to Seminole County for Chuluota and Black Hammock.

Two halves

Yes — and not with Orlando

This question is recorded here in the wording it ranks in — an article title from a contractor serving the wider metro — because people in Oviedo search it. The answer has two halves.

The statewide half is the same everywhere. Florida requires a permit for a changeout under s. 553.79(1)(a), and the new exemption at s. 553.79(1)(g) expressly excludes “any electrical, plumbing, structural, mechanical, or gas work”. A changeout is both mechanical and electrical. There is no dollar amount below which it disappears, in Orlando or in Oviedo.

The local half is where the Orlando framing misleads. The City of Orlando and Orange County each run their own permit desks and their own fee schedules, and neither has jurisdiction over a Seminole County parcel. An Oviedo address permits through one of two other desks entirely.

The 2026 permit exemption does not cover an AC changeout

A residential air conditioning changeout always requires a building permit in Florida. There is no dollar-amount exemption. The new $7,500 permit exemption for single-family work, created by HB 803 (2026) and effective 1 July 2026, expressly does not apply to “any electrical, plumbing, structural, mechanical, or gas work” — s. 553.79(1)(g)2.b., Fla. Stat. — and a changeout is both mechanical and electrical work.

If a quote is cheap because nobody is pulling a permit, that is not a saving the law allows. Bill: CS/CS/HB 803 (2026), ch. 2026-63.

Where it actually goes

The two desks an Oviedo address can fall under

Inside the Oviedo city limits

City of Oviedo Building Services, 320 Alexandria Boulevard, 407-971-5755. Its own Click2Gov portal. Fee $50 for the first $2,000 of value plus $6 per additional $1,000. The application must carry an ACCA Manual J-2016 sizing calculation and the model numbers of the replacement equipment — the City names both in its published guidelines, page 36.

Chuluota, Black Hammock and the rest of unincorporated 32765/32766

Seminole County Building Division, 1101 E. First Street, Sanford, 407-665-7050. Mandatory ePlan review. HVAC unit replacements are on the County’s list of permitted work. The county desk in detail.

Same state licence either way: air-conditioning contracting is licensed by DBPR under Chapter 489, and a certified contractor works in Orlando, Oviedo and the county on the same certificate. Check it at DBPR Verify a Licensee.

Timing

How long it takes, and who may inspect it

Five business days — when it applies

Since 1 July 2026 a local government must approve, approve with conditions, or deny a mechanical permit application within 5 business days — but only where the work is on an existing single-family dwelling, the value of the work is under $15,000, and the applicant is using the local government plans reviewer. Plenty of full changeouts now clear $15,000, and those fall into a longer tier of the same statute. Nobody should promise you five days without checking all three.

s. 553.792(1)(a)1., Fla. Stat., added by s. 10, ch. 2026-63.

You may hire a private provider instead of waiting

Florida law defines a “single-trade inspection” as an inspection focused on one construction trade, and the statute names HVAC replacements in that list. A fee owner — or their contractor with explicit written authorisation — may choose to use a licensed private provider for the plans review or the inspection instead of the local building department.

Two things this is not. It is not a lighter class of permit: the permit is still required. And it is not part of HB 803 — this definition was already in the statute before that bill, and it is an inspection category rather than a permit category.

Been told your Oviedo job does not need a permit?

It does. Ask for the permit number once the application is in, and check it on the City or County portal.
